For what purpose do we process your personal data?

Regarding the information requests made by web users, the purpose of the processing will be the management of requests for commercial information sent through the web forms available for that purpose, as well as via email. All requested data is necessary to respond to requests.

Moreover, the data provided can also be processed to send you commercial information about our products and services that could be of interest to you, by mail, email, SMS or any other equivalent electronic means. In case of not consenting data processing for sales purposes, the user will have the opportunity to refuse the reception of commercial communications, by not checking the corresponding box in the contact or information form, or even exercising his right of disagreement to the aforementioned address.

As for our customers’ personal data, the purpose of the processing is completing orders, billing services and managing the pertinent communications related to the provided service, as well as delivering commercial information about STACKSCALE products, services and events that may be of interest to you, by phone, mail or other electronic channel. You can reject the reception of sales commercials by exercising your right of disagreement to the aforementioned address.

For how long do we store your data?

Regarding the information requests of website users, data will be stored until the information request is effectively completed.

Regarding our customers’ personal information, data will be stored during the duration of the commercial relationship or during the years required for meeting legal obligations.

Commercial communications

The personal data provided to send commercial communications will continue to be stored until the interested party revokes its consent, all of that without prejudice to the right of erasure or disagreement.

Legitimization for your data processing

Regarding the information requests of website users, the legal foundation for processing your data is the consent deduced from your initiative to send an information request.

Regarding our customers’ personal information, the legal foundation is the commercial/contractual relationship and the development of business relationships.

Regarding the sending of commercial communications through any channel, including electronic ones — apart from any contractual relationship, but based on a legitimate interest since the user is the one addressing the entity —, the legal foundation is the consent requested to the user at the time, which is freely given. In case of refusing consent, STACKSCALE commits to not processing your data for advertising purposes.

Regarding the sending of commercial communications through other channels — as a result of a previous contractual relationship — the legal foundation is the legitimate interest of STACKSCALE considering the article 21.2 of the Law on Information Society Services.

To which recipient will your data be communicated?

STACKSCALE will not transfer personal data, except when there is a legal obligation to do so.

Nevertheless, there can be third parties that, as a consequence of the services provided to STACKSCALE can access personal data. Moreover, in the framework of the group to which STACKSCALE belongs, we inform that data will be communicated to the companies within the group mentioned above for corporate reasons. Are there international transfers of your data?

We do not make any international transfer of personal data.

What are your rights when providing your data?

The interested party has the right to get confirmation about whether STACKSCALE is processing personal data concerning him or not.

You have the right to address STACKSCALE, to the address mentioned in the header (attaching in any case a copy of your identification document), to access your personal data, as well as to request the modification of inexact data or, if applicable, to request the erasure when, among other reasons, the data is no longer necessary for the purpose it was collected; being also able to exercise your right of portability of your data.

Under certain circumstances, you will be able to request the limitation of the processing of your data, in which case we will only store them for the exercise or defense of complaints.

Additionally, and for reasons related to your particular situation, you will be able to reject the processing of your data. STACKSCALE will stop processing such data, except for imperative legal reasons, or for the exercise or defense of possible complaints.

Finally, under the terms set forth in the current law; you will be able to revoke any consent you may have given, including the possibility of presenting a complaint to the Dutch Data Protection Authority https://autoriteitpersoonsgegevens.nl/en.

Additional information

Users guarantee and take responsibility for, under all circumstances, the veracity, accuracy, validity and authenticity of the provided personal data, and they commit themselves to keep it properly updated. Moreover, users promise to be over 14 years old.

In the event that personal data is provided by individuals who are not the owners of such data, the user will be obliged to, prior to its inclusion, inform said individuals about the points mentioned in the previous paragraphs. In these cases, the user guarantees that the data communicated belongs to individuals over 14 years of age and that the information is accurate and true. STACKSCALE will be exempted from any responsibility for the non-compliance with these requirements by the user.

STACKSCALE has adopted the security levels of protection of personal data that are legally required, and has implemented all technical measures and means available according to the state of technology to avoid the loss, misuse, alteration, non-authorized access and theft of the provided personal data.

The user relies on the confidentiality and duty of secrecy of STACKSCALE employees and of all those that process data on his behalf. Notwithstanding the foregoing, the user is aware of the possibility that the security of the communications through the network is not invulnerable.

Data processing on behalf of the customer

During the service provision, STACKSCALE can process personal data on behalf of the customer. This data processing complies with article 28 of the GDPR and is regulated in the 4th clause of the Master Service Agreement, which can be consulted here.
